This work traces, departing from the method of structures of thought, the influence of the doctrines of Duns Scotus and Ockham in 19 th Century dogmatics. Milestones of this transformation are Windscheid’s doctrine on legal rights and Jellinek’s doctrines on public legal rights and the self-limitation of the state, as well as Laband’s distinction between the material sense of law and the formal. This multiplication of formal distinctions dissolves the modern subject in the system. Only a radical approach enables us (...) to understand the sense of legal modernity: the separation made by Scotus and nominalism between object and subject is what in the final instance explains liberal (possessive) individualism and its legal consequences. This article begins with a review of the literature on the ethics of tax evasion and identifies the three main views that have emerged over the centuries, namely always ethical, sometimes ethical, and never or almost never ethical. It then reports on the results of a survey of HK and U.S. university business students who were asked to express their opinions on the 15 statements covering the three main views. The data are then analyzed to determine which of the three (...) viewpoints is dominant among the sample population. Although it was found that HK scores were significantly different from the U.S. scores, both HK and U.S. respondents were opposed to the view that tax evasion is always or almost always ethical. The strongest arguments justifying tax evasion were in cases where the government was corrupt, the tax system was unfair and unaffordable. The weakest arguments for justifying tax evasion were in cases where there was a selfish motive. The underlying cultural differences are further explored in hope of accounting for differing perceptions of ethics of tax evasion. Policy implications for increasing people’s awareness of ethics on tax evasion are also highlighted. (shrink)

Since the 1980s, there has been a significant increase in the number of studies concerning Andalusian rural settlements linked to irrigated agriculture, both related to large suburban green belts and to small hydraulic systems. In the vast areas where water is scarce, the settlement apparently would have been concentrated in cities and fortified towns, leaving without population most of the dry lands between them. However, thanks to the intensive survey of one of these regions, La Mancha’s Southeastern area, we are (...) recording a dense rural settlement corresponding to a pattern unknown until now. It consists basically of small villages in plain, devoid of community defense elements, which must have been inhabited by humble peasants, judging by the modesty of the architecture and domestic goods. Surely they make use of the scanty natural resources, which have traditionally oriented the economy of the region towards livestock and rainfed agriculture. In particular, the studied settlement would be related to the demand of wool for the export oriented textile production of the region, within the framework of the commercial expansion of that period. Apparently, most of those villages could have appeared in the eleventh century, disappearing in the middle of the thirteenth century because of the Christian conquest. Their existence would be associated with a general context of population growth that pushed the competition between urban elites and peasants pursuing the privileged agricultural areas, as well as the colonization of less favorable production areas. Taking for granted that Marx’s economic theory enjoys a scientific status and, furthermore, that it installed a real Copernican revolution in sociology, the present paper explores the possibility of deriving a system of law deserving the name of “scientific” in so far as it would be in keeping with the theses of the latter scientific theory. In this context, the paper argues against a claim recently sustained by Fernández Liria and Alegre Zahonero, for whom a system of right compatible with (...) Marx’s theory would be compatible, too, with the classic juridical formulations conceived during the Enlightenment. The main reason why this paper testifies against such compatibility is that the enlightened concepts of “equality”, “liberty” and “autonomy” count with the individual as the realm for their juridical application. However, Marx’s subject matter being the social means of production (and not the individuals’ production of value), we conclude that the only juridical subject that could justifiably be derived from his economic investigation would be the “social class”. Finally, the paper suggests that the only way a scientific system of law could grant a juridical status to the individual would be by taking into account the other theory that also installed a Copernican revolution in the social sciences, though this time in the field of psychology: Freud’s psychoanalysis. A. Newell and H. A. Simon were two of the most influential scientists in the emerging field of artificial intelligence (AI) in the late 1950s through to the early 1990s. This paper reviews their crucial contribution to this field, namely to symbolic AI. This contribution was constituted mostly by their quest for the implementation of general intelligence and (commonsense) knowledge in artificial thinking or reasoning artifacts, a project they shared with many other scientists but that in their case was (...) theoretically based on the idiosyncratic notions of symbol systems and the representational abilities they give rise to, in particular with respect to knowledge. While focusing on the period 1956-1982, this review cites both earlier and later literature and it attempts to make visible their potential relevance to today's greatest unifying AI challenge, to wit, the design of wholly autonomous artificial agents (a.k.a. robots) that are not only rational and ethical, but also self-conscious. This reflection on Ethics in One Hundred Years of Solitude is divided in two main parts and issues. In this, the first one, thanks to the intertextual method, the author makes a journey throughout the structure, the characters and the focus of the novel to argue that ethics described there by Gabriel García Márquez is rooted in biblical myths, and how its use is a tool that gives unity to the work, and allows the author to openly reveal the human (...) condition. The second and final part of this collaboration shows and justifies how One Hundred Years of Solitude condenses an ethical approach –with vetero testamentary accent: sin/punishment– about the customs, habits, beliefs and own assessments of human action in the history of Macondo. This novel is a symbol of moral living not only in the region but in the whole world. An ethical matriarchy runs –in wretched solitude– as magma of fears and premonitions, stickler conscience and scandalous relaxation; murder, incest and (...) lust; labor exploitation, injustice, dependency and extravagance, the irreversible slope of no longer have a second opportunity on earth. Perspectivas: una aproximación al pensamiento ético y político contemporáneo recoge algunas de las conferencias pronunciadas en unas jornadas sobre pensamiento crítico, tituladas ¿Liquidar la Modernidad?, que tuvieron lugar en la Biblioteca María Moliner de la Facultad de Filosofía y Letras de la Universidad de Zaragoza en 2010. Y por otro lado, recopila las cuatro intervenciones que se produjeron en una jornada sobre pensamiento contemporáneo que, dirigida a profesorado de enseñanza secundaria, tuvo lugar en el Paraninfo de la Universidad de Zaragoza (...) el 26 de noviembre de 2011. El libro pretende también contribuir a establecer vínculos estrechos entre el Departamento de Filosofía y el profesorado de secundaria con el fin, entre otras cuestiones, de implicarse en la mejor preparación del alumnado de cara a la Prueba de Acceso a la Universidad y de facilitar la tarea docente del profesorado. En ese sentido, y puesto que actualizar el programa, dando cabida al siglo XX, parecía una cuestión necesaria, se ha configurado una aproximación a algunos autores y autoras contemporáneos, en la dimensión ética y/o política de su pensamiento, que también puede resultar útil para el profesorado de Filosofía en enseñanza secundaria. Peter Abelard (1079–1142 ce) was the most wide‐ranging philosopher of the twelfth century. He quickly established himself as a leading teacher of logic in and near Paris shortly after 1100. After his affair with Heloise, and his subsequent castration, Abelard became a monk, but he returned to teaching in the Paris schools until 1140, when his work was condemned by a Church Council at Sens. His logical writings were based around discussion of the “Old Logic”: Porphyry's Isagoge, aristotle'S Categories and (...) On Interpretation and boethius'S textbook on topical inference. They comprise a freestanding Dialectica (“Logic”; probably c.1116), a set of commentaries (known as the Logica [Ingredientibus], c. 1119) and a later (c. 1125) commentary on the Isagoge (Logica Nostrorum Petititoni Sociorum or Glossulae). In a work Abelard called his Theologia, issued in three main versions (between 1120 and c.1134), he attempted a logical analysis of trinitarian relations and explored the philosophical problems surrounding God's claims to omnipotence and omniscience. The Collationes (“Debates,” also known as “Dialogue between a Christian, a Philosopher and a Jew”; probably c.1130) present a rational investigation into the nature of the highest good, in which the Christian and the Philosopher (who seems to be modeled on a philosopher of pagan antiquity) are remarkably in agreement. Readers and historians have often misunderstood Berkeley's philosophy by believing that he denies the existence of the external world. From which they conclude that his philosophy inevitably leads to solipsism. Faced with these readings, in this paper I discuss the relationship between ontology and the external world in Berkeley with the aim of clarifying some interpretative errors and showing three things: 1) that is a mistake to believe Berkeley’s philosophy eliminate the external world and lead to solipsism, 2) that his (...) own ontology is the key to understand the constitution of the external world, and 3) that God gives the ultimate meaning of that world. / Es habitual que algunos lectores confundan la postura de Berkeley al creer que niega la existencia del mundo externo y que su filosofía lleva inevitablemente al solipsismo. Frente a estas lecturas, analizo en este artículo el tema de la relación entre ontología y mundo externo en Berkeley, con el propósito de aclarar algunos desaciertos interpretativos sobre el asunto y mostrar con ello tres cosas: 1) que se trata de un error creer que su filosofía elimina el mundo externo y lleva al solipsismo, 2) que en la propia ontología está la clave para entender la constitución del mundo externo, y 3) que Dios le da el sentido último a ese mundo. The “transformation problem” in Marx’s Capital (how to make compatible the labour theory of value from the first book with “prices of production” from the third book) has been one of the main reasons to refute the marxist theory and, at the same time, a privileged matter in order to analyze the method question. In this paper, we try to analyze the sense and foundation of the labobour theory of value discussing with any attempt of reading Marx Capital as the (...) development of a supposed “dialectic method”. Analyzing the manuscripts and drafts that Marx did not finish, we try to defend that, contrary to what Engels thought (because it had been anounced by Marx himself), it is not possible to find in the third book a trace of the so expected “dialectic solution” to the “transformation problem”. That demands, of course, a different interpretation to explain the sense of the “transformation” of value into “production prices”. (shrink)

The goal of this article is to discuss several critical positions published recently in academic journals on the book The order of ‘Capital’, which aim is to lay the foundations for a republican reading of Marx’s major work. The core of the argument focuses against any attempt to derive normative proposals from scientific discoveries. From here, clarifying some key concepts and positions of the republican tradition is a necessary condition in order to show the close solidarity between Marx and Kant (...) about the formal and institutional conditions of any possible theory of justice. In this text, we ask if analogy can enable a dialogue between religion and the social sciences. To do so, we focus in the conflict between the biblical understanding of man as a created being and the notion of human nature as a social construct. Although there seems to be a fundamental dispute in social constructivism between nature and freedom (Ian Hacking), we consider analogical reasoning (Mauricio Beuchot) enables anthropological views, like Philip Hefner’s, that include central aspects of the doctrine (...) of creation and understand nature and freedom as complementary human features, thus allowing the desired dialogue. A partir de la originalidad propia de nuestra amerindia, este Concilio se asume, integra y traduce para vivir su inspiración y derroteros fundamentales. La iglesia de la que somos testigos hoy, 50 años después de Medellín, se ha entretejido desde allí. Prueba fehaciente de ello, en este continente, son (...) aquellas comunidades que testimonian a una iglesia liberadora y misericordiosa, nazarena y samaritana, una iglesia que es pueblo de Dios y de los pobres, una iglesia comunitaria de comunidades y, siempre, en salida. Comunidades que han trabajado en aras de la paz, la justicia y la dignidad de todos; en una búsqueda y respuesta real de organización, de lucha ante la opresión y explotación de cualquier orden. RESUMEN En este trabajo analizaremos las consideraciones sobre la neutralidad y la sexualidad del Dasein en sus articulaciones con la dispersión fáctica y la libertad en las elaboraciones de Heidegger entre 1927 y 1929.En este marco nos proponemos argumentar que tales consideraciones tienen como función poner de manifiesto el carácter primario de la estructura ontológica del Ser-con y el horizonte originario de la temporeidad, desde la cual circunscribe el empuje de las dinámicas respectivas. Para ello, en primer lugar analizaremos la (...) consideración de la neutralidad y la dispersión en Sein und Zeit en el marco de sus especificaciones respecto del Dasein cotidiano. Luego, distinguiremos las especificaciones y reelaboraciones en su curso de Marburg, respecto del estatuto ontológico que le confiere a la neutralidad en sus relaciones con la concreción fáctica y la libertad. Finalmente dedicaremos el último apartado al análisis e interpretación del sentido de la neutralidad y la dispersión que articula de modo diferencial en su curso de Freiburg. Junto a ello, buscamos aportar con la clarificación del lugar que ocupa las consideraciones de la corporalidad física en este período, en diálogo con interpretaciones relevantes de su obra. ABSTRACT In this work we will analyze the considerations about Dasein´s neutrality and sexuality in their articulations with the factual dispersion and freedom in Heidegger’s elaborations between 1927 and 1929. In this framework we propose to argue that such considerations have the function of highlighting the primary character of the ontological structure of Being-with and the original horizon of temporality, from which it circumscribes the thrust of the respective dynamics. To do this, we will first analyze the consideration of neutrality and dispersion in Sein und Zeit within the framework of its specifications regarding everyday Dasein. Then, we will distinguish the specifications and reworkings in his course from Marburg, regarding the ontological status that he confers on neutrality in its relations with factual concretion and freedom. Finally, we will dedicate the last section to the analysis and interpretation of the meaning of neutrality and dispersion that he articulates in a differential way in his Freiburg course. Next to it, we seek to contribute with the clarification of the place occupied by the considerations of physical corporeality in this period, in dialogue with relevant interpretations of his work. Sören Kierkegaard y Emmanuel Levinas son dos pensadores alejados en el tiempo y su pensamiento se desarrolla en contextos filosóficos diferentes. A pesar de esta primera divergencia, ambos pensadores coinciden en su defensa de la subjetividad. En la obra de Levinas se puede encontrar algún trabajo dedicado a valorar el significado y el alcance de la obra del pensador danés. En esos trabajos, Levinas se muestra crítico en relación con la defensa de la subjetividad de Kierkegaard y en relación a (...) su propuesta de la ¿suspensión religiosa de la ética¿. La defensa kierkegaardiana de la subjetividad es interpretada por Levinas como una variación de la concepción egológica del sujeto, dominante en la tradición occidental. Pese a esta valoración crítica, este trabajo pretende rastrear que en ambos autores el origen de la subjetividad remite a la experiencia de la temporalidad y, dentro de ella, a la cuestión del fluir temporal. Es en la interpretación del flujo temporal en donde el pensamiento de ambos autores vuelve a divergir. (shrink)
